ABOUT THE SYMPOSIUM

In today's business, Intellectual Property is the most powerful commercial asset that the business possesses. In fact, Intellectual Properties are spark plugs that give thunderous start and bring investments in monetary, fixed, and intangible assets to profitable life, which otherwise could well remain dormant. It is inevitable that Intellectual Properties would enjoy enhanced prestige, as this new economic paradigm becomes dominant, and as more and more mergers, acquisitions and strategic alliances go through and the business networking expands. At the same time, the scope and definition of Intellectual Property is expanding with growth of international trade and globalization of economic activities. That is why the number of major "Intellectual Property Wars" are growing between competitors and contemporaries, besides growing threat from international exploiters. Hence, the business establishments need to understand the real scenario and profile of Intellectual Property to best utilize their IP Portfolios and the symposium is the right opportunity in understanding these issues.

At the same time, creating & holding of Intellectual Property Portfolio is one aspect, which yields no dividends and rather becomes a whiteelephant, unless commercialised. It is not like a Physical Property which even if is lying vacant may give some substantial capital gains, thus remunerating the investment. Even the characteristics of Intellectual Property are very different as compared to Physical Property, wherein largely the IP rights are not absolute. Intellectual property, if not put into use is not only dead investment as the property rights of which would expire after its legal or commercial life, but would also cost substantially in its protection and maintenance. At the same time, today, the Intellectual Property portfolios are wide open for easy grab and commercialisation. However, the Indian Business and R&D establishments largely have not exploited the value that these intangible assets provide and this educational programme would provide the real understanding of all these issues.

Creation, Protection and Exploitation of Intellectual Property is an expensive game and needs perfect business strategy. The monopoly rights in the form of Intellectual Property, granted through various statutes can only be gainfully utilised globally, if there is comprehensive knowledge on how to commercialise the monopoly rights, which are largely governed by existing Laws & Practices, which continue to undergo change as the IP definition expands. Symposium would cover and will provide real insight of all such issues; therefore the programme is a must for all senior executives of the Corporate and for professionals practicing in the related fields.

HOW THE WORKSHOP IS UNIQUE

Intellectual Property management is an essential adjunct to the core business of any Corporation and it must be aligned with other core activities. At the same time exploitation of Intellectual Property Assets is absolutely dependent on the understanding of IP Commercial issues in international scenario, which often are not deliberated, hence not well understood. At the same time, any wrong, in any step leading to commercialisation, may not only cut down the rightful commercial gains but may also lead to commercial and legal disputes, which often comes back to hunt, thereby creating complications beyond imagination. About the Institute (IIPRD)
The Institute of Intellectual Property Research and Development is established to provide education and consultancy in the field of Intellectual Property Rights in an international scenario and related services to Indian business houses. In this direction, the Institute has been regularly holding National and International Seminars/ Symposiums as one of its focused activities to educate and sensitize Indian industry. The Institute organizes these seminars on its own and in collaboration with various Government and International agencies and has held scores of such programmes at different places and platforms. The Institute has an in-house Law Firm "Khurana & Khurana, Advocates and IP Attorneys", which is one of the fastest growing IP law firms in India and through it team of highly capable Patent and Trademark Attorneys having high level of expertise across technology domains, concentrates on providing all the statutory requirements to create and protect Intellectual Properties for the corporate houses, whereas the Institute provides complete support to promote and commercialise these Intellectual Properties.

ABOUT THE FACULTY



Mr. Robert J. Gaybrick: Mr. Gaybrick is a partner in and co-chair of Morgan Lewis's Intellectual Property Practice. Gaybrick's practice focuses on licensing, negotiations, litigation, patent procurement and portfolio development, duediligence, and counseling domestic and international clients. Gaybrick was a technical advisor to Judge Phillip B. Baldwin of the Court of Customs and Patent Appeals and entered private practice in 1979. From 1983 to 1986, he was a foreign law consultant in a Japanese law office in Tokyo. Before joining Morgan Lewis to start its patent practice in 1994, Gaybrick headed the 40+ lawyer patent group of a major Washington, D.C. intellectual property firm.
Gaybrick is frequently consulted on intellectual property strategies. He has engaged in more than 100 patent licensing negotiations and transactions, many involving the top fortunes companies in the world. He has conceived and executed numerous portfolio license initiatives, including a $150M+ licensing program of computer-related intellectual property. He has been engaged in numerous patent litigations throughout the United States. He is a frequent lecturer on intellectual property topics in the United States and Asia. Prior to his legal career, Gaybrick was a computer engineer for Burroughs Corporation. His qualifications include; Columbus School of Law, 1978, J.D. ,Michigan State University, 1972, B.S.E.E. (Electrical Engineering) and Michigan State University, 1972, C.S. (Computer Science)


Mr. Vinod Khurana: Mr. Khurana has been in the field of Commercial Legal Finance for the last 35 years. Khurana started his practice in Intellectual Property in late nineties, with focus on Protection and Commercialization of Intellectual Properties. Along with Commercialisation, wherein his focus has been on IP Valuation, Due Diligence, Transfer of Technology, Licensing, and resolving IP disputes, he has been researching and educating on fighting thefts and frauds of Intellectual Properties and white-collar crimes to protect corporate properties. Khurana has represented numerous corporates for devising their investigation, Prosecution and Litigation Strategies such as Indian Oil Corporation, ITC, Bharti Televenture among many others. Khurana is the Founder Director of the Institute of Intellectual Property Research & Development and is also the President of the Institute of Forensic Accounting and Investigative Audit. He is also the Senior Partner of Khurana & Khurana Advocates & IP Attorneys. Khurana has been speaking on IP Commercialisation, Licensing, IP Valuation, Due Diligence and Theft of Intellectual Property at various National and International Seminars and has undertaken various dedicated Workshops and Seminars for well established corporates such as Wockhardt, Indian Oil Corporation, ITC, NTPC, TATA Chemicals, among many others. Department of Economic Affair, Ministry of Finance, Government of India has also empaneled him for appointment as Special Director on the Board of Sick Industrial Companies. Khurana is a member of Delhi Bar Council and has fought various National & International legal cases covering all IP Issues, infringement cases, Counterfeit cases, Licensing Disputes, Breach of Contract among other matters for best of the corporates at various platforms. His professional qualification includes B.Com, PGDFA, MBA, FICWA, CFA, LLB among other specialized qualifications in Investigation and Commercialization of Intellectual Property.
