ABOUT THE WORKSHOP
The concept of global economy is fast expanding and the foundation and focus of business have shifted from National Scenario to International Scenario, wherein the Geographical boundaries are disappearing for making business a ‘Global Market Place’. As a result the paradigm of world business is changing and one central force that is supporting this change and would regulate more closely in time to come is International Intellectual Property Laws & Practices, particularly the Patent Regime. Therefore understanding of International Patent Laws and Practices for regulating and protecting one’s business, world over, becomes critical for the business growth.
National Patent Laws & Practices differ substantially between the Nations, in terms of Grant, Scope, Protection and Enforcement mechanisms and more importantly the standards for protection and enforcement as applied by the National judiciary often vary widely, among countries. Therefore the companies particularly the Industries dealing in Pharma, Biotech, Chemicals, Ayurveda, Herbal, Traditional Art and Natural Product must have reasonable and fair assessment to International Patent Scenario for which they need to understand broadly International Laws & Practices. At the same time, the exploitation of Intellectual Property has become an Industry in itself particularly the Patent Portfolios, as the cost of development and protection of Patent in Pharma, Biotech and Chemicals is enormous, particularly obtaining the grant of Patents and their Protection thereafter as a necessity, either as pro-active or as defensive strategy. Therefore there is critical need to understand important issues such as identity of invention and priority, types of claims, formulation of set of claims, drafting and prosecution for patent dealing to successfully evaluate and enforce patent right and scope of protection as the suffering from the loss of patent could cause serious blow. That is why the number of major “Patent Wars” are growing between competitors and contemporaries, besides growing threat from international exploiters.


At the same time, National Intellectual Property Laws & Practices differ substantially between the Nations, in terms of Grant, Scope, Registration, Renewal, Protection and Enforcement mechanisms and more importantly the standards for protection and enforcement as applied by the judiciary often vary widely among countries. Therefore the companies must have reasonable and fair assessment to international protection of their Intellectual Property, for which they need to understand broadly International Laws & Practices. Industrial houses considering or obtaining grant of Patents & Trade Mark registrations and their protection thereafter, as a necessity, either as pro-active or as defensive strategy, need to understand many more issues such as identity of invention and priority, types of claims, formulation of set of claims, drafting and prosecution for patent dealing to successfully evaluate and enforce patent right and scope of protection. The issues related to Trade Mark could be the risk that trademark registration may be subjected to, cancellation for non use, how valuable it could be against counterfeiters, how registration could strengthen the value of license, how national first registrants exclusive trademark right could prevent foreign registration, the willingness of court to protect a trademark and the economics of gaining and protecting the right abroad, among other allied issues. The Seminar is organized to deliberate all these issues and provide the Indian Industry first hand information on various aspects of Patent and Trade Mark Laws & Practices in U.S.A. The Seminar is a platform to understand, deliberate and clarify all doubts on the subject, which otherwise may not be possible in short spell. About the Institute (IIPRD)

ABOUT THE FACULTY
Mr. John T. Callahan:
John Callahan received his Bachelor of Chemical Engineering in the year 1985 from Catholic University of America and his J.D. from University of Baltimore School of Law in 1990. His practice includes all aspects of intellectual property law, with a particular focus on district court litigation and interference proceedings at US.  In addition to his litigation and interference practice, Mr. Callahan counsels a variety of international and domestic clients regarding U.S. intellectual property law including providing clearance, enforceability, and validity opinions.  He also counsels clients with licensing matters, due-diligence, formulating strategy on building Patent Portfolio and assists clients in the procurement of both U.S. and foreign patents.  Mr. Callahan’s experience includes the drafting and worldwide prosecution of numerous applications as well as the specialized practice in the U.S. of reissue and reexamination proceedings. Mr. Callahan has lectured widely on U.S. Intellectual Property Laws and Practices on how to create, promote, protect and commercialize Intellectual Property Globally, in the U.S., Europe, Korea, Japan and India.

Todd B. Buck, Ph.D.
Dr. Buck is a member of the biotech practice group. His practice includes all phases of patent law, including prosecution, opinion work, litigation and transactional work.  Dr. Buck has extensive patent prosecution experience, including managing worldwide biotech and chemical patent portfolios; preparing and prosecuting utility patent applications before the U.S. Patent and Trademark Office; prosecuting international PCT applications; and procuring foreign patent rights throughout the world. Dr. Buck's counseling practice also includes providing freedom-to-operate, patentability, validity, invalidity, infringement and non-infringement analyses and opinions, including opinions used in preparing Paragraph IV certifications for Abbreviated New Drug Applications submitted to the FDA and he helps the clients to develop complete domestic and international biotech and chemical patent portfolios .
Dr. Buck obtained his doctorate from the department of Pharmacology and Toxicology, University of Georgia, College of Pharmacy. During his graduate career, Dr. Buck was awarded a fellowship from the National Institutes of Health, the National Cancer Institute, Bethesda, MD where he completed his doctoral research.

Mr. Chid Iyer:
Mr. Iyer received a B. Tech in Chemical Engineering from IIT, Bombay in 1984, an MS in Chemical Engineering from University of Akron and an MS in Computer Science from the University of Tennessee Space Institute. He received his JD from Georgetown University in 1997. Mr. Iyer is a partner of International Law Firm of Sughrue Mion and is involved in all aspects of patent practice including litigation, prosecution and client counseling in a variety of technologies including chemical, pharmaceutical, and software. Mr. Iyer has conducted and presented in various workshops and seminars on patent practice at various locations in U.S, Korea, Japan, and India. He is currently chairing the AIPLA subcommittee on IP practice in India. Prior to joining Sughrue, Mr. Iyer worked as an Engineer in chemical and software industry for a decade.

Ken Sakurabayashi:
Ken Sakurabayashi graduated with a degree in Biochemistry from the University of Colorado and received his JD from Chicago-Kent College of Law. After graduation, he researched DNA-dependent Protein Kinase with Dr. William S. Dynan at the University of Colorado and Medical College of Georgia. Ken Sakurabayashi was also a member of the Intellectual Property Department at Sumitomo Chemical Company in Osaka, Japan, where he assisted in the prosecution of patent applications throughout the world. At Sumitomo, he closely worked with inventors to draft and design claims for Japanese applications, as well as foreign application. He joined Sughue in 2005, and currently prosecutes U.S. patent applications relating to the biological sciences, pharmaceuticals, and chemical polymers.
